Why BNM Compliance Is a Technical Problem
Building a fintech product in Malaysia without understanding BNM's framework is the fastest way to an enforcement action. But most BNM guidance is written in regulatory prose designed for legal and compliance teams — not the engineers and product managers who actually build the systems.
This article translates the key BNM frameworks into practical engineering and architecture requirements for the most common fintech product categories.
The Licence Landscape
Digital Banking Licence (DBL)
Five licences were awarded in 2022 to GXS Bank, Boost Bank, RHB-Grab, Sea-CIMB, and AEON-MoneyMatch. DBL holders can offer a full range of banking services. If you're building technology for one of these licensees, you'll need to meet BNM's technology risk management (TRM) requirements, which are the most rigorous in the market.
Money Services Business (MSB) Licence
Required if your product facilitates currency exchange, remittance, or money changing. The e-money sub-category covers digital wallets and stored-value instruments. Key technical requirement: real-time AML transaction monitoring against BNM's FIU sanctions lists.
Recognised Market Operator (RMO)
Required for investment platforms, robo-advisors, and peer-to-peer lending. The Securities Commission Malaysia (SC), not BNM, is the primary regulator here — but BNM's AML/CFT requirements still apply.
Technology Risk Management (TRM) — The Engineering Standard
BNM's TRM framework (updated 2023) is effectively a 200-page security and resilience standard. The headline requirements that affect your architecture:
- System availability: 99.95% uptime for customer-facing systems. Plan your SLA architecture accordingly — this means multi-AZ deployments, not single-instance setups.
- Recovery time objective (RTO): For critical systems, RTO must be under 4 hours. RPO (recovery point objective) for transaction data must be near-zero.
- Penetration testing: Annual pen tests by an approved third party, with results reported to BNM for regulated entities.
- Change management: All production changes to critical systems must follow a documented change management process. Emergency changes require post-event reporting.
- Third-party risk: Cloud providers and key technology vendors used by licensed entities must be assessed and approved. AWS, Azure, and GCP are all in-scope and require specific contractual provisions.
e-KYC Requirements
BNM issued specific e-KYC guidance that allows financial institutions to onboard customers digitally — without in-person verification — subject to specific technical controls:
- Liveness detection: Your identity verification flow must include certified liveness detection. BNM specifies minimum accuracy thresholds. Passive photo matching is not sufficient.
- MyKad OCR and validation: You must validate the MyKad against the National Registration Department (NRD) database via the authorised API. Screenshots are not acceptable.
- Risk-based limits: e-KYC onboarded customers are subject to lower transaction limits until enhanced due diligence (EDD) is completed. Your system must enforce these limits programmatically, not manually.
AML/CFT — Real-Time Transaction Monitoring
Anti-money laundering requirements are arguably the most complex technical challenge for fintech builders. Your system must:
- Screen every customer onboarding against OFAC, UN, and BNM sanctions lists in real time
- Monitor transaction patterns for anomalies and flag them for compliance review
- Generate Suspicious Transaction Reports (STRs) and submit them to BNM's FIU via the goAML system
- Maintain immutable audit logs of all AML screening decisions for a minimum of 7 years
"The biggest mistake fintech founders make is treating BNM compliance as a pre-launch checkbox. It is an ongoing operational requirement that needs to be designed into your architecture from day one."
We've built systems for BNM-regulated and aspiring-regulated entities across Malaysia. If you're planning a digital banking, payments, or lending product and need to understand the technical compliance architecture, we're happy to advise on what the right foundation looks like before you write the first line of code.
